This website is operated by Tomayle LLC, operating as Tomayle (“Tomayle,” “we,” “us,” or “our”), a limited liability company registered in the State of Wyoming, USA.
These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, digital content, services, and related features (collectively, the “Services”).
By accessing our website, placing an order, purchasing a product or digital product, booking a service, or otherwise using our Services, you agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy, Disclaimer, and any other policies made available on our website.
If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms excludes, restricts, or limits any rights or remedies that cannot lawfully be excluded, restricted, or limited under applicable law.
SECTION 1 - ELIGIBILITY AND USE OF THE SERVICES
You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to make a purchase, request a Personalized Skincare Assessment, submit photographs, or book a paid service through our website.
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You must not use our website, products, content, or Services in any manner that violates applicable law, infringes the rights of others, interferes with the operation or security of the website, or attempts to gain unauthorized access to any system, account, or data.
We reserve the right to refuse service, cancel orders, restrict access, or terminate accounts where reasonably necessary, including in cases of suspected fraud, abuse, unlawful activity, security concerns, or violation of these Terms, subject to applicable law.
SECTION 2 - PRODUCTS AND PRODUCT INFORMATION
Tomayle may offer products and services including Gua Sha tools, skincare and cosmetic products, eBooks and other digital products, online sessions, Personalized Skincare Assessments, and other beauty, skincare, wellness, lifestyle, or educational products and services.
We make reasonable efforts to display product descriptions, photographs, colors, dimensions, ingredients, materials, and other information accurately.
However, colors and appearance may vary depending on your screen, device, lighting, photography, and, where applicable, the natural characteristics of the product.
Product availability, specifications, packaging, pricing, and other product information may change from time to time.
Nothing on our website constitutes a guarantee of a particular cosmetic, skincare, wellness, or other result unless expressly stated otherwise.
SECTION 3 - NATURAL STONE AND GUA SHA PRODUCTS
Our Gua Sha tools may be made from natural stone.
Because natural stone is a naturally occurring material, each piece may vary in color, shade, pattern, markings, veining, transparency, texture, thickness, shape, and other characteristics.
These natural variations are inherent characteristics of natural stone and do not, by themselves, constitute defects.
Product photographs are intended to provide a reasonable representation of the product. The individual stone received may differ in appearance from the stone shown in photographs.
Gua Sha tools should be handled and used carefully and in accordance with the instructions or guidance provided.
Natural stone may break, chip, or become damaged if dropped, struck, subjected to excessive pressure, or otherwise mishandled.
You should discontinue use if the product becomes cracked, chipped, damaged, or unsafe to use.
You should also discontinue use if you experience unusual pain, significant irritation, injury, or another adverse reaction.
Gua Sha products and techniques are intended for cosmetic, wellness, and educational purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
SECTION 4 - SKINCARE AND COSMETIC PRODUCTS
Customers are responsible for reviewing product ingredients, directions, warnings, and other product information before use.
Individual skin responses vary. A product that is suitable for one person may not be suitable for another.
Where appropriate, we recommend performing a patch test before using a new skincare or cosmetic product.
Do not use a product if you know or reasonably suspect that you are allergic or sensitive to an ingredient.
Products should be used only as directed and for their intended purpose.
If you experience a significant or unexpected adverse reaction, discontinue use and seek appropriate professional advice where necessary.
If you have a medical condition, diagnosed skin condition, allergy, are pregnant, are taking medication, or have concerns regarding the suitability of a product, you should consult an appropriately qualified healthcare professional before use.
Tomayle does not guarantee that any skincare or cosmetic product will produce a particular result.
SECTION 5 - WELLNESS, SKINCARE AND EDUCATIONAL INFORMATION
Information provided through our website, products, eBooks, videos, social media, online sessions, Personalized Skincare Assessments, or other Services is intended for general educational, cosmetic, lifestyle, and wellness purposes only.
It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease, illness, injury, or medical condition.
Our Services are not a substitute for diagnosis, treatment, or advice from an appropriately qualified healthcare professional.
Customers should seek appropriate professional advice for medical symptoms, medical conditions, suspicious lesions, significant or persistent skin concerns, or questions regarding medical treatment.
Individual experiences and results may vary.

SECTION 6 - ORDERS
By placing an order, you are making an offer to purchase the selected products or Services.
We reserve the right to accept or decline an order where permitted by applicable law, including where a product is unavailable, information or pricing is incorrect, payment cannot be authorized, fraud is suspected, or we cannot lawfully fulfill the order.
An automated order confirmation does not necessarily constitute final acceptance of an order.
We may limit or cancel quantities purchased where reasonably necessary to prevent fraud, unauthorized resale, abuse, or other misuse of our Services, subject to applicable law.
If we cancel an order after payment has been received, we will provide an appropriate refund in accordance with our Return & Refund Policy and applicable law.
You are responsible for ensuring that your billing, shipping, contact, and payment information is accurate and complete.
SECTION 7 - PRICES AND PAYMENT
Prices are displayed in the currency indicated on the website and may change without notice.
The price applicable to an order will generally be the price displayed at the time the order is submitted, subject to correction of genuine errors and applicable law.
Any applicable shipping charges, taxes, duties, or other charges will be displayed or communicated where required before completion of the purchase.
You agree to provide current, complete, and accurate billing and payment information.
By submitting payment information, you represent that you are authorized to use the selected payment method.
Payments may be processed by third-party payment service providers. Their applicable terms and privacy practices may also apply.
SECTION 8 - SHIPPING AND DELIVERY
Physical products are currently available for shipping to customers in the United States, as further described in our Shipping & Delivery Policy.
Gua Sha products may be fulfilled and shipped directly from China.
Skincare and cosmetic products for customers in the United States may be fulfilled and shipped from within the United States.
Products in the same order may therefore be fulfilled from different locations, shipped separately, and arrive at different times.
Estimated delivery times currently include:
Gua Sha products - Free Standard Shipping: approximately 10-15 business days.
Gua Sha products - Faster UPS Shipping: approximately 7-10 business days, where available, for an additional charge displayed at checkout.
Skincare products: approximately 5-8 business days.
Business days do not include weekends or public holidays.
Delivery times are estimates and are not guaranteed delivery dates.
Shipping times may be affected by carrier operations, customs procedures, weather, public holidays, high-volume periods, fulfillment delays, incorrect or incomplete delivery information, or other circumstances outside our reasonable control.
Shipping destinations, costs, tracking availability, and additional delivery information are described in our Shipping & Delivery Policy and, where applicable, at checkout.
Customers are responsible for providing complete and accurate delivery information.
If we are unable to ship an order within an applicable promised timeframe, we will provide any notice, cancellation option, consent request, or refund required by applicable law.
SECTION 9 - CUSTOMS, DUTIES AND IMPORT CHARGES
Products shipped internationally or from outside the customer’s country may be subject to customs procedures, import requirements, duties, taxes, or other charges.
The treatment of such charges depends on the shipping service selected and the applicable shipping arrangement.
Where duties, taxes, or import charges are included in a particular shipping option, this may be indicated at checkout or in the applicable shipping information.
Where such charges are not included and are lawfully payable by the recipient, the customer may be responsible for payment.
Tomayle does not control customs authorities, customs processing times, or charges independently imposed by governmental authorities.

SECTION 10 - RETURNS, REFUNDS AND FINAL SALES
Returns, cancellations, exchanges, and refunds are governed by our Return & Refund Policy.
Except where expressly stated in that Policy or where otherwise required by applicable law, sales of physical products are final and we do not accept returns or exchanges due to change of mind, personal preference, ordering the wrong product, or because a customer no longer wants the product.
This does not affect the provisions of our Return & Refund Policy relating to damaged, defective, incorrect, or lost products or other circumstances in which a remedy is required by applicable law.
Customers should not send a product back without first contacting Tomayle and receiving return instructions where a return has been authorized.
Nothing in these Terms or our Return & Refund Policy excludes or limits any rights or remedies that cannot legally be excluded or limited.
SECTION 11 - DIGITAL PRODUCTS AND EBOOKS
Digital products, including eBooks and downloadable or electronically delivered materials, may be delivered by download link, electronic access, email, or another digital delivery method.
Unless expressly stated otherwise, digital products are licensed to the purchaser solely for personal, non-commercial use.
Purchase of a digital product does not transfer ownership of the intellectual property contained in that product.
You may not copy, reproduce, distribute, resell, sublicense, publish, upload, share, commercially exploit, or otherwise make a digital product available to another person without our prior written permission.
You may not upload or distribute our eBooks or other protected digital materials through websites, social media, file-sharing services, online groups, marketplaces, artificial intelligence datasets, or other distribution channels without our prior written permission.
Except where otherwise required by applicable law, sales of digital products are final and non-refundable after the digital product has been delivered, downloaded, accessed, or otherwise made available.
Technical problems with accessing a purchased digital product should be reported to Tomayle so that we can make reasonable efforts to assist.
SECTION 12 - ONLINE SESSIONS
Tomayle may offer live online educational, cosmetic, skincare, lifestyle, wellness, or other appointment-based Services.
Appointments may be conducted using Google Meet or another communication method specified or agreed upon.
Online sessions are provided for educational, cosmetic, skincare, lifestyle, and wellness purposes.
They do not constitute medical diagnosis or treatment and are not a substitute for advice from an appropriately qualified healthcare professional.
No particular result is promised or guaranteed.
Customers are responsible for determining whether participation is appropriate for them and for following instructions carefully.
Requests to reschedule should be made at least 24 hours before the confirmed appointment and are subject to availability.
Late cancellations, missed appointments, refunds, and rescheduling are governed by our Return & Refund Policy.
If Tomayle is unable to provide a purchased session and a reasonable alternative appointment cannot be agreed upon, an appropriate refund will be provided.
SECTION 13 - COMPLIMENTARY CALLS AND VIDEO SESSIONS
From time to time, Tomayle may offer a complimentary telephone or video session in connection with the purchase of an eligible product or digital product.
Unless expressly stated otherwise, a complimentary session has no separate purchase price and no cash value.
Complimentary sessions may be subject to scheduling requirements, availability, expiration periods disclosed with the offer, or other reasonable conditions.
The inability or failure to use a complimentary session does not by itself create a right to a refund for the associated purchased product, except where otherwise required by applicable law.
SECTION 14 - PERSONALIZED SKINCARE ASSESSMENT
Tomayle may offer a Personalized Skincare Assessment based on information voluntarily supplied by the customer, which may include questionnaire responses, skincare concerns, information about skincare products and routines, relevant lifestyle information, optional health-related information, and facial or skin photographs.
The Personalized Skincare Assessment is prepared by a professionally qualified esthetician with more than 20 years of professional skincare experience. The service provider’s professional qualification was obtained outside the United States.
The service provider does not represent that she holds a state-issued United States esthetician, cosmetology, dermatology, medical, or other healthcare license in the customer’s state or jurisdiction.
The Personalized Skincare Assessment is a remote cosmetic, skincare, wellness, and educational service. It does not involve a physical examination, medical examination, medical diagnosis, medical prescription, medical treatment, or the performance of a hands-on esthetic procedure.
Customers are responsible for providing information and photographs that are reasonably accurate, complete, current, and suitable for preparing the assessment.
The quality and usefulness of the assessment depend in part on the accuracy, completeness, quality, and relevance of the information and photographs provided.
Certain questionnaire information and suitable photographs may be required to prepare the assessment. Health-related information identified as optional in the questionnaire is voluntary.
Tomayle may request additional information or clearer photographs before beginning or completing an assessment.
Tomayle may be unable to prepare or complete the assessment if the customer does not submit the required questionnaire information, photographs, or consent, or if the submitted material is incomplete, unclear, unsuitable, or raises a concern that should be evaluated by an appropriately qualified healthcare professional.
The Personalized Skincare Assessment will generally be delivered electronically within 48 hours after Tomayle receives all required information, required photographs, and required consent.
The Personalized Skincare Assessment is provided solely for cosmetic, skincare, wellness, and educational purposes.
It does not constitute a medical examination, medical diagnosis, prescription, or treatment and should not be relied upon as a substitute for evaluation, diagnosis, or treatment by a dermatologist, physician, or other appropriately qualified healthcare professional.
Tomayle does not diagnose medical skin conditions or evaluate whether a lesion, mole, growth, rash, infection, or other skin change is benign, malignant, or otherwise medically significant.
Customers should seek appropriate medical advice regarding suspicious lesions, persistent symptoms, unexplained changes, significant irritation, infections, medical conditions, or other health concerns.
We do not guarantee any particular skincare, cosmetic, wellness, health, or appearance-related result from recommendations, guidance, or information provided through the assessment.
The customer remains responsible for deciding whether to use a recommended product or follow any skincare guidance, reviewing product ingredients and warnings, performing an appropriate patch test, and seeking professional medical advice where necessary.
Information and photographs provided for a Personalized Skincare Assessment will be collected, used, stored, retained, and deleted as described in our Privacy Policy.
Before submitting the questionnaire, the customer must provide the required acknowledgments and consent relating to the nature of the service and the collection and use of submitted information and photographs.
Refunds and cancellation terms applicable to the Personalized Skincare Assessment are described in our Return & Refund Policy.
SECTION 15 - INTELLECTUAL PROPERTY
All content made available through the Services, including text, photographs, graphics, logos, branding, product designs, videos, digital downloads, eBooks, educational materials, illustrations, website content, and other original materials, is owned by or licensed to Tomayle LLC and is protected by applicable intellectual property laws.
Unless expressly authorized otherwise, you may access and use such content only for your personal, non-commercial use.
You may not copy, reproduce, modify, distribute, republish, upload, sell, license, commercially exploit, create derivative works from, or otherwise use our protected content without prior written permission from Tomayle LLC, except where such use is expressly permitted by applicable law.
Tomayle names, branding, logos, and other identifying marks may not be used without our prior written permission.
SECTION 16 - CUSTOMER CONTENT AND INFORMATION
Where a Service requires you to submit photographs, questionnaire responses, messages, or other information, you represent that you have the right to provide that material to us.
You retain ownership of photographs and other original content that you provide to us.
You grant Tomayle permission to use submitted material only to the extent reasonably necessary to provide the requested Service, communicate with you, maintain appropriate business records, comply with legal obligations, protect against fraud or misuse, or as otherwise described in our Privacy Policy.
We will not use customer photographs for advertising, social media, before-and-after marketing, or other promotional purposes without separate appropriate permission.
Photographs and information submitted for a Personalized Skincare Assessment will be handled and deleted as described in our Privacy Policy.
SECTION 17 - THIRD-PARTY SERVICES AND LINKS
Our Services may contain links to or integrations with third-party websites, applications, payment processors, communication platforms, fulfillment providers, carriers, analytics providers, questionnaire providers, storage providers, or other services.
We do not control third-party services and are not responsible for their independent content, availability, security, policies, or practices to the extent permitted by applicable law.
Your use of third-party services may be subject to their separate terms and privacy policies.
SECTION 18 - SHOPIFY
Our online store is hosted using Shopify’s ecommerce platform.
Shopify provides technology that enables us to operate our online store and may process information in connection with providing its services.
Purchases from Tomayle are transactions between you and Tomayle LLC except where expressly stated otherwise.
Certain Shopify functionality may also be subject to Shopify’s applicable terms and privacy practices.
SECTION 19 - PRIVACY
Our collection, use, storage, retention, and disclosure of personal information are described in our Privacy Policy.
This includes information that may be submitted in connection with purchases, customer service, online sessions, Personalized Skincare Assessments, analytics, or advertising technologies.

SECTION 20 - PROHIBITED USES
You may not use the Services for unlawful, fraudulent, abusive, harmful, deceptive, or infringing purposes.
You may not introduce malicious software, interfere with website security, attempt unauthorized access, impersonate another person, submit fraudulent information, misuse payment systems, or materially interfere with the operation of the Services.
You may not systematically copy, scrape, extract, reproduce, distribute, or commercially exploit protected website content except as permitted by applicable law or with our prior written permission.
You may not use our Services, products, content, or intellectual property in a manner that violates the rights of Tomayle or any third party.
We may take reasonable measures to protect our Services, customers, intellectual property, and business from misuse.
SECTION 21 - DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and information made available through them are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be available, uninterrupted, error-free, or completely secure.
We do not guarantee particular results from the use of our products, digital content, educational materials, online sessions, Personalized Skincare Assessments, or other Services.
Natural variations in stone products and differences in individual skincare or wellness results do not, by themselves, constitute a product defect or failure of the Services.
Except for warranties, guarantees, or rights that cannot lawfully be excluded, warranties are disclaimed to the fullest extent permitted by applicable law.
Nothing in this section excludes or limits any warranty, guarantee, or consumer right that cannot legally be excluded or limited.
SECTION 22 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Tomayle LLC and its members, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or related to the Services, products, or these Terms.
To the fullest extent permitted by applicable law, Tomayle will not be responsible for loss, injury, or damage resulting from misuse of a product, use of a damaged product, failure to follow provided instructions or warnings, use contrary to product directions, inaccurate or incomplete information provided by the customer, known allergies or sensitivities, or reliance on educational, cosmetic, lifestyle, skincare, or wellness information as a substitute for appropriate professional or medical advice.
Customers are responsible for using products and following techniques in accordance with the instructions, warnings, and information provided.
Individual results may vary, and Tomayle does not guarantee any specific cosmetic, skincare, wellness, health, or appearance-related result.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence where it cannot lawfully be excluded, or any other liability that cannot legally be excluded or limited under applicable law.
Nothing in this section limits any mandatory consumer rights.
SECTION 23 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Tomayle LLC and its affiliates, members, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, material breach of these Terms, infringement of another person’s rights, or intentional misuse of our Services.
This provision does not apply to the extent prohibited by applicable law.
SECTION 24 - ERRORS, INACCURACIES AND AVAILABILITY
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, availability, pricing, promotions, shipping, or other information.
We reserve the right to correct errors and update information, subject to applicable law.
We may also modify or discontinue products, Services, promotions, or website features from time to time, subject to obligations relating to existing purchases and applicable law.
If an error materially affects an order that has already been placed, we will handle the matter in accordance with applicable law.
SECTION 25 - FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL
To the extent permitted by applicable law, Tomayle will not be responsible for delay or failure to perform an obligation where the delay or failure results from circumstances outside our reasonable control.
Such circumstances may include severe weather, natural disasters, carrier disruptions, transportation interruptions, customs delays, governmental actions, labor disruptions, telecommunications or internet failures, widespread service outages, or other events beyond our reasonable control.
This section does not affect any cancellation, refund, delivery, or other rights that cannot legally be limited under applicable law.
SECTION 26 - TERMINATION
We may suspend or terminate access to the Services where reasonably necessary because of a material violation of these Terms, unlawful conduct, fraud, security concerns, or misuse of the Services.
Termination does not affect rights or obligations that arose before termination or provisions that by their nature should survive termination.
SECTION 27 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 28 - GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising from or relating to them will be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except to the extent that mandatory applicable law provides otherwise.
Nothing in this section deprives a consumer of rights or protections that cannot lawfully be waived or excluded.
Where permitted by applicable law, disputes relating to these Terms or the Services will be subject to the jurisdiction of the competent courts located in Wyoming, USA.
SECTION 29 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, products, business practices, technology, or legal requirements.
The version published on our website will be the current version and will display the applicable “Last updated” date.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes will not retroactively reduce rights that have already arisen under an existing transaction where prohibited by applicable law.
SECTION 30 - ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy, Disclaimer, and any other terms expressly incorporated by reference, constitute the agreement between you and Tomayle regarding your use of the Services, subject to rights that cannot be waived under applicable law.
A failure by Tomayle to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
